These Policies (hereinafter, the “Policies”) condition the use of the services of the Internet portal http://www.ign.gob.do (hereinafter, the “Portal”) of the Instituto Geográfico Nacional “Joaquín Hungría Morell” (hereinafter, the “IGN-JJHM”), a governmental institution attached to the Ministry of Economy, Planning and Development, created by Law No.208-14 G.O. No.10760 of June 30, 2014, with its domicile and main offices at Calle Jonas Salk esq. Benigno Filomeno Rojas No. 101, Zona Universitaria, Santo Domingo de Guzmán, Distrito Nacional, capital of the Dominican Republic.

1. Conditions

Minors. – In order to use the Services that require the collection of Personal Data by the IGN-JJHM through the Portal, minors must obtain prior permission from their parents, guardians or legal representatives, who will be held responsible for all acts carried out by minors under their care.

Obligation to make correct use of the Portal and the Services. – The User undertakes to use the Portal and the Services in accordance with the law, these Policies, the Terms of Use, the Particular Conditions of certain Services and other notices and instructions made known to them, as well as public order, morality and generally accepted good customs.

The User must abstain from obtaining or even attempting to obtain the Contents by using means or procedures other than those which, as the case may be, have been made available for this purpose or have been indicated on the Web pages where the contents are found or, in general, those which are normally used on the Internet, provided that they do not entail a risk of damage or disablement of the Portal, the Services and/or the contents.

2. No License

All trademarks, trade names or distinctive signs of any kind that appear on the Website are the property of the IGN-JJHM or third parties, and it may not be understood that the use of or access to the Website and/or the Services attributes to the User any right over the aforementioned distinctive signs.

Likewise, the Contents are the intellectual property of the IGN-JJHM or of third parties, without it being understood that, by virtue of the provisions of these Policies, none of the exploitation rights that exist or may exist over said contents may be understood to be ceded to the User beyond what is strictly necessary for the correct use of the Portal and the Services, that is to say, the User may consult, copy and store on the hard disk of his/her computer or any other physical support, print or reproduce the material available on this Website, exclusively for his/her personal or private use, or that which is carried out within his/her company or organisation, mentioning at all times the ownership that the IGN-JJHM has over it, and it is strictly forbidden to make alterations, modifications or decompilation of its content.

The commercialisation in any form and under any title of the material contained in this site is strictly prohibited without the prior written authorisation of the IGN-JJHM. This portal may contain information from other sources, and in such cases the consent of the source must be obtained for its reproduction.

Neither does the IGN-JJHM guarantee the usefulness of the Portal and the Services for the performance of any specific activity, nor their infallibility and, in particular, but not exclusively, that the User can effectively use the Portal and the Services, access the different Web pages that make up the Portal or those from which the Services are provided.

IGN-JJHM EXCLUDES ALL LIABILITY FOR DAMAGES OF ANY KIND THAT MAY BE DUE TO THE LACK OF AVAILABILITY OR CONTINUITY OF THE FUNCTIONING OF THE PORTAL AND THE SERVICES, TO THE DEFRAUDING OF THE USEFULNESS THAT THE USER MAY HAVE ATTRIBUTED TO THE PORTAL AND/OR THE SERVICES, TO THE FALLIBILITY OF THE PORTAL AND/OR THE SERVICES, AND IN PARTICULAR, BUT NOT EXCLUSIVELY, TO FAILURES IN ACCESS TO THE DIFFERENT WEB PAGES OF THE PORTAL OR TO THOSE FROM WHICH THE SERVICES ARE PROVIDED.

Lawfulness, reliability and usefulness. – The IGN-JJHM does not guarantee the legality, reliability and usefulness of the services provided by third parties through the Portal. IGN-JJHM EXCLUDES ALL LIABILITY FOR DAMAGES OF ANY KIND THAT MAY BE GENERATED BY THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.

4. Procedure in the event of unlawful activities being carried out

In the event that any User or third party considers that there are facts or circumstances that reveal the unlawful nature of the use of any content and/or the carrying out of any activity on the Web pages included or accessible through the Portal, and, in particular, the violation of intellectual property rights or other rights, they must send a notification to the IGN-JJHM stating the following:

Personal details of the claimant: name, identity card number (or passport number, in case of foreigners), address, telephone number and e-mail address;

Specification of the alleged unlawful activity carried out on the Portal and, in particular, in the case of an alleged violation of rights, precise and specific indication of the protected content, as well as its location on the web pages;

Facts or circumstances that reveal the unlawful nature of such activity;

In the event of infringement of rights, handwritten signature or equivalent, with the Personal Data of the holder of the allegedly infringed rights or of the person authorised to act in the name and on behalf of the latter;

Express, clear and under the responsibility of the claimant that the information provided in the notification is accurate and of the unlawful nature of the use of the contents or the carrying out of the activities described.

5. Notifications

All notifications and communications (hereinafter, the “Notifications”) by the User to the IGN-JJHM shall be considered effective, for all purposes, when sent to us by courier to the following address: Calle Jonas Salk esq. 6. Applicable Legislation

These Policies are governed in each and every one of its parts by the laws of the Dominican Republic.

The IGN-JJHM and the User, with tacit waiver of any other jurisdiction, submit to the courts of the Dominican Republic.
